## Kommentar zur Pressemitteilung des UBA vom   6\. September 2024 

 

Berlin, 11. September 2024: Das Umweltbundesamt (UBA) hat am vergangenen Freitag verkündet, dass es erste Upstream-Emission-Projekte zur Anrechnung auf die Treibhausgasminderungs-Quote im Verkehrssektor aberkannt hat, bei denen Branchenakteure seit Monaten Verdacht auf Betrug geäußert hatten. Die neu gegründete Initiative Klimabetrug Stoppen, die sich die Aufklärung und Verhinderung dieser Betrugsfälle am Klimaschutz zum Ziel gesetzt hat, begrüßt die Nachricht aus dem UBA, kritisiert aber auch den langsamen Fortschritt der Ermittlungen sowie Regelungslücken in der Rückabwicklung gefälschter Nachweise.  

Als Initiative Klimabetrug Stoppen begrüßen wir es, dass das UBA nun erste Projekte geprüft und aberkannt hat. Wir werten dies als einen ersten wichtigen Erfolg unserer Arbeit, denn es waren die Mitglieder unserer Brancheninitiative, die das UBA auf die Spur der Betrugsvorfälle geführt haben. Nichtsdestotrotz ist es ernüchternd, dass dadurch lediglich die Spitze des Eisbergs betrachtet wird. Die ersten Hinweise auf Betrug rund um UER-Nachweise gingen vor über einem Jahr im August 2023 beim UBA ein. 

Dass nun über ein Jahr später gerade einmal acht Projekte abschließend untersucht wurden, ist in keiner Weise zufriedenstellend. Hätten die Behörden unsere Hinweise ernst genommen, wären sie heute vermutlich auf demselben Kenntnisstand wie wir und wüssten, dass 68 von 69 Projekten anzuzweifeln sind. Im Juni 2024 hat Prof. Messner öffentlich das Betrugsgeflecht bestätigt, das die Branche seit langem erkannt hat. Wir fragen uns daher, warum seither nur so wenige Projekte und nicht alle 69 unter die Lupe genommen wurden. Die Vorhaben, die nun geprüft wurden, decken sich auch nicht mit den Projekten, bei denen das ZDF bereits Unstimmigkeiten festgestellt hatte. Es wäre nur konsequent gewesen, an die Vorarbeit durch die Recherchen des ZDF anzuknüpfen und so wertvolle Zeit zu sparen. 

Auch die Bekundung des UBA, dass für jede Analyse eigens vor Ort in China jeder Stein umgedreht werden muss, können wir nicht nachvollziehen. Hätten die Behörden ihre eigenen Regularien beachtet und am Beginn des Prozesses zur Anmeldung eines neuen Projektes Handelsregisterauszüge und angemessene Bürgschaften eingefordert, wäre sehr rasch offenkundig geworden, dass die Firmen hinter den Projekten bestenfalls höchst fragwürdig sind. Allein das reicht allemal aus, um einen Anfangsverdacht zu begründen und die Projektträger aufzufordern, selbst die vermeintliche Rechtmäßigkeit ihrer Projekte zu belegen. Dies würde die Ressourcen im UBA schonen, den Prozess massiv beschleunigen und die Leidensfähigkeit der redlichen Marktakteure hierzulande nicht zusätzlich strapazieren. 

Wir kritisieren zudem, dass am Beispiel der jetzt aberkannten Projekte das größte Problem des Betrugsmechanismus "UER" zu Tage tritt: Aufgrund der von uns seit Monaten angemahnten Regelungslücke in der UER-Verordnung führt diese formale Aberkennung nämlich nicht dazu, dass der nachweislich nicht erbrachte Klimaschutz aufgrund der fehlenden THG-Minderung nachgeholt wird. Es gibt keinerlei Rechtsfolge, die für eine Marktbereinigung sorgen würde.  

Diesen eklatanten Missstand zu beseitigen ist eines der wichtigen Ziele unserer Initiative und gilt im Übrigen auch für die mutmaßlich gefälschten Biodieselimporte. Wir haben daher die Hausleitung der beteiligten Ministerien um einen kurzfristigen Gesprächstermin gebeten, um Lösungen dieser Problematiken zu finden und die Betrugsprävention zu stärken.
