# Kommentar

## Initiative Klimabetrug Stoppen kommentiert den Refe-rententwurf des BMUV zur 3. Änderung der 38. BImSchV

 

**Berlin, 14. Oktober 2024. Das Bundesumweltministerium hat im Rahmen der Verbändeanhörung zur Stellungnahme für einen „Referentenentwurf zur dritten Verordnung zur Änderung der Verordnung zur Festlegung weiterer Bestimmungen zur Treibhausgasminderung bei Kraftstoffen“ aufgerufen. Die Initiative Klimabetrug Stoppen kommentiert:**

Positiv hervorzuheben ist die Möglichkeit eines Neustarts ab dem Verpflichtungsjahr 2025, was sodann zu einer Stabilisierung des Marktes und zur Wiederherstellung des Vertrauens in den Handel mit Treibhausgasminderungsquoten (THG-Quoten) beitragen könnte. Die verlängerte Prüfzeit für die Quotenanmeldungen der Jahre 2023 und 2024 bis 2027 ermöglicht eine gründliche Klärung von Betrugsvorwürfen.

Weitere Maßnahmen von Seiten der Bundesregierung sind stark erwünscht, allerdings bleibt die aktuelle Ausführung weit hinter den Erwartungen zurück. Denn der Vorschlag beinhaltet zwar eine schnell umsetzbare Nachsteuerung auf administrativer Seite, doch aufgrund von nicht ausreichend geregelten Unklarheiten entstehen Lücken, Risiken und Belastungen für alle Beteiligten.

Insbesondere lässt die geplante Verordnung das Verpflichtungsjahr 2024 unbeachtet und führt eher kurzfristig zu weiterer Marktdestabilisierung: Dem ohnehin stark angegriffenen Markt für 2024 wurde damit noch weiterer Schaden zugefügt. Strukturelle Probleme werden so nicht gelöst, sondern vielmehr zeitlich verschoben.

Um einen weiteren Schaden zu verhindern, fordert die Initiative:

- eine nationale Registrierung (Zulassung) und **Kontrolle** im Regulierungsprozess sowie das Ausarbeiten geeigneter Maßnahmen zur **Betrugsprävention**

- Nutzung der **Übererfüllung von 2024** im Jahr 2025 ebenfalls **streichen bzw. ebenfalls auf das Quotenjahr 2027 zu verschieben**

- eine klare Regelung zur Übertragbarkeit der Quoten durch Dritte: **Dritte sollten die Möglichkeit erhalten, Quoten aus einem Verpflichtungsjahr auch über zwei Jahre mitzunehmen** (Beispiel: Quoten von Dritten aus 2023 ebenfalls auf 2027 verschieben).

- Ersatz von gefälschten UER-Einsparungen durch Einsparungen anderer Erfüllungsoptionen ermöglichen (rechtmäßige UER-Einsparungen reichen dafür nicht aus)

- Schaffung eines Ausgleichsmechanismus für nicht mehr rückabwickelbare, gefälschte UER-Einsparungen
