# Stellungnahme

## Stellungnahme zu der jüngsten Handlung der Bundesanstalt für Landwirtschaft und Ernährung:

 

**Berlin, 7. Mai 2025:**

Die Bundesanstalt für Landwirtschaft und Ernährung hat Nachhaltigkeitsnachweise für Biokraftstoffe, die die Behörde am 15.04.2025 zu Untersuchungszwecken temporär gesperrt hatte, wieder freigegeben (siehe [Mitteilung der BLE vom 06.05.2025](https://www.ble.de/DE/Themen/Klima-Energie/Nachhaltige-Biomasseherstellung/nachhaltige-biomasseherstellung_node.html)). Dabei handelt es sich um erhebliche Mengen von angeblich abfallbasiertem HVO, das laut Papieren in einer unter ISCC zertifizierten Anlage in den Vereinigten Arabischen Emiraten produziert wurde. 

Für die BLE hat sich der Verdacht erhärtet, dass diese Anlage überhaupt nicht existiert und die bis Januar 2025 ausgestellten Nachweise gefälscht wurden. Trotzdem können nach der Freigabe Händler und deutsche Quotenverpflichtete die mutmaßlich gefälschten Nachweise weiterverkaufen oder auf die deutsche THG-Quote anrechnen lassen. 

Grund dafür ist der sogenannte Vertrauensschutz gemäß § 17 Abs. 2 der Biokraftstoff-Nachhaltigkeitsverordnung: Um Nachhaltigkeitsnachweise im Besitz von Händlern oder Quotenverpflichteten zu löschen, müsste die BLE ihnen nachweisen, dass sie beim Kauf der Nachweise Kenntnis von dem Betrug hatten. Das ist in der Praxis so gut wie unmöglich. 

In den meisten Ländern besteht kein Vertrauensschutz – so ist beispielsweise in den USA der Inverkehrbringer von Kraftstoffen verpflichtet, seine Lieferkette eigenverantwortlich zu überwachen.

„Der Vertrauensschutz muss ohne Wenn und Aber reformiert werden“, sagt Stefan Schreiber, Sprecher der Initiative Klimabetrug Stoppen. „Weil der Vertrauensschutz in dieser Form existiert, kümmert sich keiner um die erforderliche Sorgfalt. Betrug muss für alle Beteiligten Konsequenzen haben.“

Für die Initiative Klimabetrug Stoppen steht fest: Unter der aktuellen Rechtslage gibt es für die Profiteure von Betrug praktisch keine Konsequenzen, den Schaden tragen der heimische Markt und alle sauber arbeitenden Anbieter von erneuerbaren Energien im Verkehr. Deshalb muss zum einen das Mandat der BLE für die Aberkennung gefälschter Nachweise gestärkt werden. Einer entsprechenden Änderung der Biokraftstoff-Nachhaltigkeitsverordnung – etwa einer Beweislastumkehr, bei der die Käufer von gefälschten Nachweisen selbst ihre Unkenntnis des Betrugs und die Wahrnehmung ihrer Sorgfaltspflicht belegen müssen – stehen keine EU-rechtlichen Hürden entgegen. Zum anderen müssen falsche Nachhaltigkeitsnachweise dauerhaft aberkannt und aus dem Markt gezogen werden.
